Named Persons

A named person is a person that has been nominated by a person that is under a mental health detention.  However, even if you are not a named person it may be possible to receive legal representation for proceedings under legal aid.

Ormistons being very much focused and specialised on areas of the Mental Health represent named persons and families regularly.

It is quite often the case that named persons or interested parties will contact us as there is a mental health tribunal scheduled and they want legal representation for this. A named person or interested party is entitled to legal aid for this regardless of finances. Likewise contact may be made as the named person or interested parties are not content with the current detention of the detained person and wish to appeal against the detention, measures or perhaps an aspect of care, treatment, etc. Please contact us and we can advise on options.

What can be expected?

We aim to see new clients same day or within 24 hours regardless of where you are.
You will always work with a solicitor with mental health legal experience in tribunals and representation.
A helpful and empathetic telephone advice line to assist with all your queries.
We aim to provide a prompt service as we understand that a passage of time is more time spent under compulsory measures.

Legal Aid

11th Dec
Legal Aid is available to all eligible clients. Eligibility is assessed by solicitors and is available in full for persons that are detained under the Mental Health (Care and Treatment) (Scotland) Act 2003 and wish to consider appealing. This is also available to named persons and interested parties.
