Our clients are often subject to mental health detentions and compulsory measures in the hospital and have legal rights to appeal against these measures. A detention can vary from a short term detention, compulsory treatment order, compulsion order and restriction order. A person can even feel as though they are detained but they are not on any legal order keeping them in hospital. Any person subject to measures, or any person that acts as a named person, primary carer or welfare guardian in relation to a person subject to such measures is entitled to Legal Aid to exercise their legal rights of appeal. An appeal can take many forms, whether that be seeking revocation of legal detentions altogether, having them varied to community or to consider whether they are appropriately placed in terms of security level.
